1. PERSONAL DATA

Thank you for working with Theobroma Systems. The protection of your personal information is important to us. In the following document, we describe how we collect and process your personal information when you use our website and share information with us via our contact forms, job application forms or Newsletter forms.

Theobroma Systems Design und Consulting GmbH, with the address Seestadtstrasse 27, 1220, Wien, AUSTRIA collects and controls your personal information in accordance with the EU GDPR regulations. Theobroma Systems reserves the right to update, modify or extend the Privacy Policy from time to time.

Theobroma Systems, processes and uses your personal data only with your consent or mandate. We collect your personal data such as your name, email address, phone number, company name, physical address and other personal data through communication with you via email, phone, via our contact forms on our website, via events and conferences.

Only such personal data will be collected which are necessary for the execution and processing of our services or which you have voluntarily made available to us.

2. INFORMATION AND DELETION

As a client or as a person affected in general, you have the right – subject to our duty of confidentiality – at any time to request information about your stored personal data, their origin and recipient and the purpose of data processing as well as the right to correction, data transmission, objection, restriction of processing as well as blocking or deletion of incorrect or inadmissibly processed data.

If there are any changes to your personal data, please inform us accordingly.

You have the right to revoke us your consent to use your personal data at any time.

If you are of the opinion that the processing of your personal data by us violates the applicable data protection law or that your data protection claims have been violated in any other way, please get in touch with us immediately.

3. DATA SECURITY

The protection of your personal data takes place through appropriate organizational and technical precautions. These precautions relate in particular to protection against unauthorized, illegal or accidental access, processing, loss, use and manipulation.

Irrespective of our efforts to maintain a reasonably high level of due diligence at all times, it cannot be ruled out that information that you disclose to us via the Internet may be viewed and used by other persons.

Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorized access by third parties (e.g. hacking of email accounts or telephone, interception of faxes).

4. USE OF DATA

We will not process the data provided to us for purposes other than those covered by our company duties or by your consent or otherwise by any provision in accordance with the GDPR. Excluded from this is the use for statistical advertising and marketing purposes, provided that the data provided has been made anonymous.

We collect and use your personal information for the following purposes:

  1. To respond to your emails and inquiries and conduct all communications with you
    • Personal Data: address; city; company name; country; email address; first name; last name; phone number; User ID; website; ZIP/Postal code/
  2. To inform and update you about all product and software updates, information about other products and services we offer.
  3. To update you about our latest product and services, company news, innovations, partnerships. The information will be delivered to you as a Newsletter via emails. We use third-party service platforms to manage and deliver our Newsletter but do not allow access of the third party to your personal data. You will always have the option to unsubscribe from our mailing lists.
  4. To improve your user experience when navigating our website through cookie collection. The information we may process for these purposes may include the Internet Protocol (IP), time-zone setting, operating system and platform, browser type and version, and information about your visit to our website.
  5. For recruiting purposes; we collect data through our Careers page via direct application or if you are referred to us by a friend. In both cases, we make sure to ask for your permission to keep your data in our newsletter lists.

5. RECRUITING INFORMATION

If you apply directly, we will keep your data in our system for the entire recruiting process and may ask for an opt-in if you would like to stay subscribed to our newsletter for future job openings. If you are referred to us by a friend, we will inform you and ask for your permission of contacting you and keeping you in our database for future newsletters on other job openings.

As part of any recruitment process,Theobroma Systems collects and processes personal data relating to job applicants. Theobroma Systemsis committed to being transparent about how it collects and uses that data and to meeting its data protection obligations.

Information we collect

Theobroma Systems collects a range of information about you.

This includes:

  • your name, address and contact details, including email address and telephone number;
  • details of your qualifications, skills, experience and employment history;
  • information about your current level of remuneration, including benefit entitlements;
  • information about your entitlement to work in Austria;

Why does Theobroma Systems process personal data?

Theobroma Systems is required to process data to validate your application and establish a contractual relationship with you. In some cases, Theobroma Systems is required to process data to make sure it complies with its legal obligations. For example, it is required to check a successful applicant’s eligibility to work in Austria before employment starts. Theobroma Systems has a legitimate interest in processing personal data during the recruitment process and for keeping records of the process. Processing data from job applicants allows Theobroma Systems to manage the recruitment process, assess and confirm a candidate’s suitability for employment and decide which candidate to select for the job. Theobroma Systems may also need to process data from job applicants to respond to and defend against legal claims.

Theobroma Systems will not use your data for any purpose other than the recruitmennt scope for which you have applied.

Who has access to data?

Your information will be shared internally for the purposes of the recruitment process. This includes the HR team, other members involved in the interview process and managers.

Theobroma Systems will not share your data with third parties, unless it is so required for the recruitment process to obtain references for you from previous employers.

At the same time, Theobroma Systems will be required to share your data with the relevant government institutions to obtain you a working permit, if you are not entitled for employment in Austria. Theobroma Systems will not transfer your data outside the European Economic Area

Your rights as a data subject, you have a number of rights:

You can:

  • access and obtain a copy of your data on request;
  • require Theobroma Systems to change incorrect or incomplete data;
  • require Theobroma Systems to delete or stop processing your data, for example where the data is no longer necessary for the purposes of processing;
  • object to the processing of your data where Theobroma Systems is relying on its legitimate interests as the legal ground for processing; and
  • ask Theobroma Systems to stop processing data for a period if data is inaccurate or there is a dispute about whether or not your interests override the organisation’s legitimate grounds for processing data.

6. TRANSFER OF DATA TO THIRD PARTIES

In order to fulfil your order and our business relationship it may also be necessary to pass on your data to third parties (e.g. business partners, lawyers, accountants, tax consultants or other service providers that we use and to whom we make data available, etc.), courts or authorities. Your data will be forwarded exclusively on the basis of the GDPR, in particular to fulfil your order or on the basis of your prior consent.

Furthermore, we inform you that within the scope of our activities and support, factual and case-related information is regularly obtained from you by third parties.

7. DISCLOSURE OF DATA BREACHES

We make efforts to ensure that data breakdowns are detected at an early stage and, if necessary, reported immediately to you or the responsible supervisory authority, taking into account the respective data categories affected.

8. STORAGE OF DATA

We will retain data for at least as long as is necessary to fulfil our contractual or legal obligations and to ward off any liability claims.

We will retain your consented personal data for our newsletter and mail lists until you decide to revoke your consent. You can unsubscribe at any time.

9. COOKIES AND ANALYTICS TOOLS

This website uses “cookies” to make our website more user-friendly, effective and secure.

A “cookie” is a small text file which we transmit via our web server to the cookie file of the browser on the hard disk of your computer. This enables our website to recognize you as a user when a connection is established between our web server and your browser. Cookies help us to determine the frequency of use and the number of users of our Internet pages. This website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. All information collected will be stored in Google’s servers in USA.

10. SERVER LOG FILES

In order to optimize this website in terms of system performance, user-friendliness and the provision of useful information about our services, the provider of the website automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. This includes your Internet protocol address (IP address), browser and language settings, operating system, referrer URL, your Internet service provider and date/time.

These data will not be merged with personal data sources. We reserve the right to subsequently check this data if we become aware of concrete indications of illegal use.
